ANNUAL STARTING SALARY:     $71,710 (Job Group 13)

Exam Type: Notice of Vacancy - *Please note this position is currently pending jurisdictional classification by New York State Civil Service and will be filled on a temporary basis. If the position is deemed competitive then appointments made will be provisional pending a future civil service competitive examination for permanent appointment. After the exam, selection for appointment(s) will be made from reachable candidate(s) on the eligible list according to the NYS Civil Service Rule of Three.
 

DISTINGUISHING FEATURES OF THE CLASS:
This work involves leading an initiative to create and implement policies and procedures related to the compilation and exchange of discoverable materials as articulated in NYS Criminal Procedure Law §245. Recent changes in the law will: 1) reduce the statutory time frame for discovery from 45 days to 20 days if an individual is in custody and 35 days if they are out of custody; 2) increase the amount of categories of material to be provided during discovery from 11 to 21; 3) require discovery prior to the entry of a plea of guilty and; 4) connect disclosure obligations with the provisions of speedy trial governed by CPL §30.30. This position is performed under the daily supervision of an Assistant District Attorney as well as the Chief of Administration. This position will also report on a regular basis to the District Attorney.


TYPICAL WORK ACTIVITIES:

  • Maintain current knowledge of all related laws, rules and regulations and any modification or implementation changes re: CPL     §245 and §30.30 speedy trial provisions;
  • Supervises team of Senior Clerk Typists/Discovery Expediters/Confidential Discovery Liaisons and others responsible for discovery-related data collection and dissemination in compliance with CPL §245 and §30.30 speedy trial provisions;
  • Participates as a member of Discovery Leadership Team alongside Deputy District Attorneys, Bureau Chiefs, Assistant District    Attorneys and the Chief of Administration regarding CPL §245 and §30.30 speedy trial provisions;
  • Assists in the creation of policies and protocols that maintain compliance with CPL §245 and §30.30 speedy trial provisions;
  • Serves as a liaison between the Erie County District Attorney and law enforcement agencies/crime laboratories as well as the  Legal Aid Bureau of Buffalo and Bar Association of Erie County’s Assigned Counsel Program in addition to other defense counsel regarding the people’s discovery obligations;
  • Works with DA Information Technology staff to evaluate and utilize efficient discovery collection and dissemination tools;
  • Serves as an office resource for attorneys and support staff as it relates to body camera evidence.

 

PERFORMANCE KNOWLEDGES, SKILLS, ABILITIES AND PERSONAL CHARACTERISTICS:
Thorough knowledge of laws, rules and regulations related to CPL §245 and §30.30 speedy trial provisions; ability to work in an interdisciplinary position with attorneys, paralegals, secretaries and clerical staff to accomplish successful prosecution of cases; skill in preparing reports and analyzing data; ability to oversee the work of other employees; ability to establish and maintain effective working relationships with a diverse constituency; ability to perform daily tasks with a high degree of accuracy; initiative and resourcefulness; capable of performing the essential functions of the position with or without reasonable accommodation.
 

MINIMUM QUALIFICATIONS:
A) Graduation from a regionally accredited or New York State registered four (4) year college or university with a Bachelor’s Degree in Criminal Justice, Paralegal Studies, Legal Studies or related field and (3) three years of experience related to the collection and maintenance of evidence in criminal proceedings;

B) Graduation from a regionally accredited or New York State registered two (2) year college or university with an Associate’s Degree in Criminal Justice, Paralegal Studies, Legal Studies or related field and 5 years of experience related to the collection and maintenance of evidence in criminal proceedings.

C) An equivalent combination of training and experience as defined by the limits of (A) and (B).

NOTE: Admission to the Bar in New York State may be substituted for any of the above experience or qualifications.

NOTE: Verifiable part-time and/or volunteer experience will be pro-rated toward meeting full-time experience requirements.
