NYS Agricultural and Markets Law requires the submission of an Agricultural Data Statement (ADS) by an applicant to the municipality for a rezoning, special use permit, site plan approval, use variance, or subdivision of parcel(s) occurring on property within a NYS Agricultural District containing a Farm Operation or on property within 500 feet of an active Farm Operation located in an NYS Agricultural District.
Once completed, the ADS:
Must be provided, along with a written notice of the proposed project, to all adjacent landowners identified herein; and
Must be evaluated and considered by the local reviewing board (e.g., planning board, zoning board of appeals, municipal governing board) to determine the possible impacts of the proposed project on Farm Operations with the NYS Agricultural District; and
Must be referred to the Erie County Department of Environment and Planning. Submission of this form fulfills this requirement.
