The Office of Consumer Protection wants to highlight the recent press regarding private pool rentals in Erie County and New York State. It is important to pay close attention to your rights and responsibilities when pursuing an opportunity for additional income like renting your private pool or residence, especially when utilizing a third-party company or app.
Be diligent in reviewing all terms and conditions in any contract and ensure that you check with your local municipality for additional requirements. It is your responsibility to secure the proper insurance and any required licensing which may protect you from certain liability in case of an accident or injury.
Although it may be convenient and definitely attractive to earn extra income, there are risks and legal ramifications that outweigh the financial benefits of opening your home or property up to strangers.
Per the Erie County Department of Health;
Individuals who rent their private swimming pool to the public without a permit are violating state sanitary code and putting themselves at risk of penalties/fines. New York State allows penalties of up to $2,000 per violation. Complaints about swimming pools operating without a permit can be sent to the Erie County Department of Health Division of Environmental Health at (716) 961-6800.
