REQUEST FOR EXCEPTION

“Biometrics Transparency and Privacy Act”

Pursuant to Local Law No. 1-2026, §7 (2026) and Rule No. 11 and 12, of the Rules and Regulations adopted by the Director of Consumer Protection, Commercial Establishments may use this form to submit a written Request for Exception from Local Law No. 1-2026 (2026). All sections of this form must be completed. Pursuant to Rule No. 12, Commercial Establishments must submit all documentation which supports the Commercial Establishments position that an Exception is applicable.

2. In accordance with local Law 1-2026, §5(a) (2026), any Commercial Establishment in possession of Biometric Information must provide a summary of the amount and type of Biometric Information in its possession.

3. Provide a detailed summary identifying the purpose and function for the Biometric Information in the Commercial Establishments possession.

4. Pursuant to Local Law No. 1-2026, § 7(2026) or Rule No. 11 of the Rules and Regulations, identify the Exception that the Commercial Establishment maintains is applicable to its business and provide the Legal Basis, with supportive documentation supporting the reasoning for the Exception.
