MANDATORY NOTICE

“Biometrics Transparency and Privacy Act”

Pursuant to Erie County Local Law No. 5-1, Section 4 (2026), Commercial Establishments are prohibited from collecting, storing, procuring, using and selling or otherwise monetizing a Customer’s Biometric Identifier Information in Commercial Settings.

In compliance with the “Biometrics Transparency and Privacy Act”, within thirty (30) days from the effective date of this local law, all Erie County Commercial Establishments must provide written notice to the Director of the Erie County Division of Consumer Protection whether such Commercial Establishment is in possession of Biometric Information. Such notice must include (i) the amount and type of Biometric Information in its possession and; (ii) a Destruction Policy detailing the method and timing for permanent deletion and/or destruction of all such Biometric Information.

Commercial Establishments may use this form to provide written notice to the Director pursuant to Erie County Local Law No. 5-1, Section 5(a) (2026).
