New York State Lead Rental Registry and Proactive Rental Inspections

The New York State Lead Rental Registry is a statewide program to identify and remediate lead hazards in pre- 1980 rental units located in "communities of concern" in New York State. This program aims to reduce childhood lead poisoning by requiring landlords to register their properties, conduct lead hazard inspections, and ensure prompt remediation of any identified hazards.

What Properties Are Affected?

The NYS Lead Rental Registry applies to residential rental units in Erie county that meet all 3 of the following criteria:

  1. The residential property has 2 or more rental units.
  2. The residential property is located within “Communities of Concern” (CoC). For Erie County, this encompasses the following zip codes: 14201, 14204, 14206, 14207, 14208, 14210, 14211, 14212, 14213, 14214, 14215, and 14225 (west of I-90).
  3. The residential property was built before 1980. To check the year a property was built, you can search the database.

Rental Lead Inspections, Remediation and Certifications

Rental Lead Inspections

Starting November 3, 2025, rental properties will be inspected at least once every 3 years. These inspections will check for possible causes of lead poisoning, such as:

  • Paint with lead that is peeling, chipping, or that can be easy to breathe in or swallow.
  • Other dangers that could expose people to a lot of lead.

Fixing Lead Problems

If the inspector finds any lead problems, the property owner will get a Notice of Violation. They will have 45 days to fix the problems using safe practices. Only trained workers can do the repairs, including:

  • EPA Certified Renovators
  • EPA Lead Abatement Workers or Supervisors

And they must work under an EPA Certified Firm. If they don’t fix the problems on time, they could be fined or face other penalties.

Getting Certified

After the repairs are finished, a special lead dust test will be done. 

If the property passes inspection, the property owner will receive a Certificate of Compliance that is good for 3 years.
